Terms & Conditions – Nine & Above Apparel AB

First things first – we know that legal text is probably not what you’d choose to read for pleasure. But our Terms & Conditions are here to protect both you as a customer and us as a brand.

We’ve written them with the same honesty and care we put into our products – but legal language has its own tone, so we hope you’ll forgive the more formal style that follows.

0. Introduction

These Terms & Conditions apply to all purchases made through www.nineandabove.com, with delivery within Sweden, the European Union, and other countries where Nine & Above offers shipping.

They set out the terms for the sale and purchase of goods between you as an individual customer and Nine & Above Apparel AB via our online store at www.nineandabove.com.

Nine & Above Apparel AB is a Swedish limited liability company (Aktiebolag) registered under organisation number 559296-4786, VAT registration number SE559296478601, with its registered office in Bålsta, Sweden.

1. Overview

Nine & Above Apparel AB (hereinafter “Nine & Above”) designs and sells clothing and related products for male riders.

Our products are sold exclusively through our online store at
www.nineandabove.com and are available to private individuals aged 18 or over. By completing a purchase, you agree to these Terms & Conditions.

Nine & Above is a registered trademark within the EU. All rights to the name, logo, design, and content on this website are owned by Nine & Above or its partners.

We process personal data in accordance with our Privacy Policy, available on our website.

2. Orders & Agreement

A binding purchase agreement is formed once you receive an order confirmation by email.

We reserve the right to reject or cancel orders if incorrect information has been provided or if fraud is suspected.

You must be at least 18 years old to make a purchase.

3. Prices, Payment & Credit

For purchases made from EU countries, prices are displayed in the local currency, including VAT.

For deliveries outside the EU, local taxes or import duties may apply according to the regulations of the destination country.

Certain payment methods may be limited depending on your location. The available payment options will be displayed at checkout based on your delivery address.
We currently offer the following payment methods:
Visa, Mastercard, Amex, Maestro, Klarna, PayPal, and Swish (Sweden).

If you choose to pay by invoice or instalments, a separate credit agreement is entered into with your chosen payment provider (e.g. Klarna), and their terms and credit checks will apply.

All payments are processed via a secure, encrypted SSL connection.

If an obvious error in pricing or product information occurs, we reserve the right to correct the error and cancel the order.

4. Shipping & Delivery

We ship orders from our warehouse in Sweden to customers within Sweden, the EU, and selected countries outside the EU. Orders placed before 18:00 CET are normally dispatched the following business day.

Deliveries are primarily handled by DHL or UPS.

Estimated delivery times:
Sweden: 2–4 business days
EU: 2–6 business days
Outside EU: 3-7 business days

Free shipping applies to orders above 150 EUR / 1 500 SEK / 1 200 DKK / 700 PLN / 3 600 CZK (incl. VAT) within the EU. For lower order values, fixed shipping rates are shown at checkout before completing your purchase.

For non-EU countries, free shipping thresholds vary due to shipping costs and regulations applicable for the destination country. Current order value thresholds per country:

Norway: 1800 NOK (incl. VAT)
UK:
£150 (excl. VAT)
Switzerland & Liechtenstein: 250 CHF (excl. VAT)
USA: 450 USD (excl. any sales taxes)

Nine & Above is responsible for the goods until they have been delivered to you (when you or someone authorised by you has received the shipment). If your parcel is damaged upon arrival, please report it immediately to the carrier.

You are responsible for ensuring that all details provided when placing your order, including delivery address and contact information, are correct. If a shipment cannot be delivered due to incorrect or incomplete details, Nine & Above may charge the actual costs for re-delivery or return handling.

Deliveries to Norway
Nine & Above is registered in Norway’s VOEC system (VAT On E-Commerce). Norwegian VAT (mva) is charged at checkout and reported directly to the Norwegian Tax Administration (Skatteetaten).

VOEC applies to consignments where each individual product’s value is below 3,000 NOK excluding VAT (approximately 3,750 NOK including VAT, excluding shipping and insurance). The total order value may exceed this threshold as long as no single product exceeds the limit.

Shipments to Norway containing any item above this limit are handled under standard import rules, and the customer is responsible for VAT and any applicable customs duties upon import.

Deliveries outside the EU (excluding Norway)
For deliveries to all other non-EU countries, the recipient is responsible for any customs duties, taxes, or import charges applied upon arrival. These fees are determined by the customs authorities of the destination country and are beyond our control.

Deliveries to the United Kingdom
Due to UK VAT regulations, we can only process and ship orders to the United Kingdom with a total goods value exceeding £135 (excluding VAT and shipping costs).

In the event of delays beyond our control, force majeure applies.

5. Returns (Right of Withdrawal), Exchanges & Refunds

You have a 30-day right of return from the date you received your order (the statutory right of withdrawal is 14 days). The item must be unused, in saleable condition, and returned in its original packaging with intact labels and seals.

To initiate a return, contact us at hello@nineandabove.com and include your order number. You may also use the EU standard withdrawal form provided by your local consumer authority. Once the return has been registered, the product(s) must be shipped back within 14 days.

Return shipping fees:
We encourage conscious purchases and charge a fixed return fee to guide towards reduction of unnecessary shipments and emissions. The fee is automatically deducted from your refund:

  • Sweden: 75 SEK
  • Other EU countries: 10 EUR
  • Outside EU: 15 EUR

We provide a prepaid return label via e-mail once your return has been registered. You are responsible for the goods until they reach us – please pack carefully and keep your receipt/tracking number.

Exchanges are made by:
a) registering your return as described above, and
b) placing a new order for the desired item.

Refunds are processed as soon as possible, and no later than 14 days after you notify us of your withdrawal. We may withhold the refund until we have received the returned item or proof that it has been sent, whichever occurs first.

Refunds are issued using the same payment method as your original order. If the item has been handled more than necessary to determine its nature, characteristics, or function, a deduction may be made for any reduction in value.

6. Uncollected Shipments

Uncollected parcels generate additional handling and carrier charges. Therefore, a fixed zone-based fee will be deducted from your refund to cover actual return shipping and administrative costs incurred by Nine & Above:

  • Sweden: 150 SEK
  • Germany: 20 EUR
  • Other EU countries: 25 EUR
  • Outside EU: 40 EUR

Please note that you must collect your parcel even if you intend to exercise your right of withdrawal and register a return. If you do not collect the parcel, the above fee replaces the standard return shipping fee outlined in section 5.

7. Complaints (Defective Products)

We stand behind the quality of our products. If you receive a defective or incorrect item, contact us at hello@nineandabove.com with your order number, name, and a brief description of the issue. Including photos helps us resolve your case more quickly.

Your right to make a complaint follows the consumer protection laws of your country of residence. In Sweden, the statutory period is three (3) years under the Swedish Consumer Sales Act.

Complaints must be made within a reasonable time after discovering the defect. A complaint submitted within two months is always considered timely.

If your complaint is approved, we will first attempt to repair the item; if not possible, we will replace it with a new or equivalent product, or, as a final option, issue a refund. This right does not cover normal wear and tear, misuse, or damage caused after delivery, including washing or treatment contrary to care instructions.

If a complaint is approved, Nine & Above covers the return shipping and no return fee is charged.

If you are dissatisfied with how we handle your case, you may contact the appropriate dispute resolution body as described in section 10 below.

8. Products & Liability

We make every effort to ensure that product descriptions and colours are accurately represented. However, slight variations may occur due to factors such as screen settings.

We reserve the right for potential typographical errors, price adjustments, or out-of-stock items. 

Nine & Above is not liable for indirect or consequential damages resulting from the use of our products.

Material composition and care instructions are provided in accordance with EU Regulation 1007/2011 on textile labelling. We also comply with EU Regulation 2023/988 on general product safety.

9. Pricing, Promotions & Customer Benefits

Nine & Above sets fair and consistent prices from the outset and does not engage in seasonal sales or short-term discounts. Our prices reflect quality, craftsmanship, and production close to our customers.

Prices may vary between markets due to local currencies, taxes, duties, and logistics costs.

Promotions or bundled offers may be available from time to time, but they cannot be combined unless explicitly stated.

In the event of a partial return from a bundled offer, the original price of the retained products will revert to their standard price. Refunds for returned items will therefore be adjusted accordingly.

10. Dispute Resolution & Governing Law

Swedish law governs these Terms & Conditions.

If you reside within the EU and a dispute cannot be resolved directly with us, you can find competent national consumer dispute resolution bodies via the European Commission:

In Sweden, you can contact The National Board for Consumer Disputes (ARN) at www.arn.se. Nine & Above always follows ARN’s recommendations.

For customers outside the EU, Swedish law applies, and any disputes shall be finally settled by Swedish courts, with Uppsala District Court as the court of first instance.

In extraordinary circumstances beyond our control – such as natural disasters, war, governmental actions, pandemics, or technical disruptions – force majeure applies.
During such events, our obligations are suspended for as long as the situation persists.
If it continues for more than 60 days, both parties are entitled to cancel the purchase without compensation.

11. Privacy Policy Reference

Nine & Above processes personal data in accordance with applicable law (GDPR).
For more details on how we handle personal data, cookies, and data transfers outside the EU/EEA, please refer to our Privacy Policy on the website.

For customers outside the EU, local data protection laws may grant additional or differing rights.

12. Customer Confidence

Your confidence when shopping with Nine & Above is our highest priority.

  • We offer a 30-day return period (compared to the statutory 14 days).
  • Our pricing policy guarantees stability without sales or seasonal campaigns.
  • Our products are shown on real riders with diverse body types for an authentic view of fit and appearance.
  • We provide payment solutions that include buyer protection (e.g. Klarna).
  • Should a dispute arise, we always follow ARN’s decisions.
  • Nine & Above complies with all laws and regulations governing consumer trade within Sweden and the EU.

13. Sustainability

Sustainability is a key part of Nine & Above’s philosophy. Our products are designed in Sweden and manufactured close to our customers – primarily in Europe – to minimise transportation and ensure fair working conditions.

We carefully choose materials, methods, and logistics to reduce environmental impact.
Our goal is to create riding apparel for men with long-lasting quality – where durability, functionality, and responsibility always outweigh short-term trends or low-cost production.
This applies to each product as well as to our long-term, continuously evolving collections, rather than frequent seasonal rotation.

14. Scope & Language

These Terms & Conditions apply to purchases with delivery to countries within the European Union (EU) and other countries where Nine & Above offers delivery.

If mandatory consumer protection laws in your country of residence provide stronger rights than stated here, those rights shall take precedence.

These Terms & Conditions do not limit your statutory consumer rights.

In case of discrepancies between the Swedish, English, and German versions of these Terms & Conditions, the Swedish version shall prevail within the EU, while the English version shall apply to customers outside the EU.
